In this text, Dr. George Pamborides and Mr. Petros Karydis note the need to reform the institutional framework for the exercise of nolle prosequi, which grants the Attorney General unfettered power to discontinue criminal prosecutions. They emphasize that the existing framework creates shadows in the judiciary, contradicts European principles and has prompted repeated recommendations from the EU and the Council of Europe. The authors propose substantial reforms, such as the separation of powers, justification of decisions and enhanced transparency, with the aim of restoring public trust and strengthening the rule of law.

This text presents the presentation delivered by Mr. Joseph Frangos at the Institute's Esperida, held on Wednesday, November 12, 2025, on the topic "Excessive Powers and Institutional Counterweights in the Republic of Cyprus: The Challenge of Reform", and which was organized in collaboration with UCLan Cyprus and with the support of the Larnaca and Famagusta Bar Associations. Mr. Joseph Frangos examines and analyzes the proposed separation of powers of the Attorney General, assessing whether the reform actually serves the public interest and raises key questions. The author presents the arguments in favor of change, the recommendations of European institutions and the institutional weaknesses of the current framework, but at the same time expresses serious reservations regarding its constitutionality. It also emphasizes that it may cause serious institutional risks if it is later deemed unconstitutional. Finally, it calls for careful, documented and not hasty institutional action.
